License for making investments abroad

The National Bank of Ukraine regulates performance of transactions related to investment of funds made by the residents abroad through issue of individual licenses for making investment abroad.

As prescribed with the law of Ukraine, investment abroad is a currency transaction which implies acquisition by investing entities of fixed and intangible assets, equity rights, securities and their derivatives in exchange for currency values in order to gain profit or to achieve a social effect.

Any transactions by residents relating to transfer of funds for maintenance of own representative offices (branches) abroad based on their estimate of expenditure (except for acquisition of real property abroad), to payment of membership (subscription) fees to any foreign (international) organizations and institutions, including fees for participation in international systems of transportation, telecommunication, communication etc, insurance and healthcare services, as well as opening of accounts in foreign banks are not referred to investments.

In case a transaction may be qualified as an investment, a resident is obliged to apply to the National Bank of Ukraine for a relevant license and submit a package of documents as required by law.

Based on results of the documents review, the National Bank grants a license to an investor or its representative, in case there are no grounds for refusal.
