Trademarks

The history of a trademark starts originates the ancient times when craftsmen started to put a special mark on their goods. Today, a trademark is an integral attribute of every successfully developing company.

As provided with the law of Ukraine, a trademark may be represented with any designation or any combination of designations which are appropriate to distinct goods (services) produced (supplied) by one person from the goods (services) produced (supplied) by other persons. Such designations, in particular, may include words, letters, digits, pictorial elements, color combinations.

Intellectual property right for a trademark may be held by individuals and legal entities. Intellectual property right for a certain trademark may be simultaneously held by several individuals and (or) legal entities.

A registered trademark provides its owner with an exclusive right for its use, an exclusive right to allow use of his/her/its trademark, an exclusive right to prevent unlawful use of a trademark, and also to prohibit such use, as well as other intellectual property rights provided by law.

Accrual of intellectual property right for a trademark is confirmed with a certificate. Such certificate is valid during 10 years of the application date and each time is renewed for another 10 years if requested so by the certificate holder.
